Terms & Conditions for Vendors

Thank you for applying to be part of the Colorado Makers Market (“we,” “us,” “our”). By submitting your application, you agree to be bound by these Terms & Conditions (“Terms”).


1. Definitions

  • We/Us/Our: Colorado Makers Market
  • You/Your: The applicant, including your business, employees, contractors, or representatives participating in your booth space.
  • Space: The booth area assigned to you at our market.
  • Vendor: Any person or business granted a space at our market, including their staff and agents.
  • Vendor’s Manual: A guide provided by us that outlines rules, logistics, and safety guidelines.
  • Intellectual Property Rights: Includes copyrights, trademarks, designs, patents, business names, and related creative assets.
  • Confidential Information: Information that is not publicly available and should be treated as private under these Terms.
  • Cash Box: Legal tender (coins/bills) used to make change.
  • EFTPOS: Electronic funds transfer at point of sale.

2. Applications

Applications are evaluated based on:

  • Creativity and originality
  • Product presentation and professionalism
  • Commitment to independent design
  • Market fit and uniqueness

We reserve the right to accept or decline any application at our sole discretion.


3. Vendor Fee

If accepted, you must pay your vendor fee in full by the stated deadline. Failure to pay may result in loss of space. Fees do not include tables, racks, or chairs unless otherwise stated. You must bring your own display furnishings.


4. Cancellations

Vendor-initiated cancellations after the participation fee is paid are non-refundable. If the market is canceled by us, see Section 16.


5. What to Bring

You are responsible for supplying:

  • Display and promotional materials
  • Cash box or card reader (we do not supply change or EFTPOS systems)
  • Packaging materials or bags for customer purchases

6. Payment Systems

You are responsible for your own payment collection setup (Square, Venmo, credit card reader, etc.).


7. Rental Term

Booth spaces are rented on a one-time basis. Acceptance to one market does not guarantee acceptance to future events.


8. Non-Transferable

Your booth may not be sold, transferred, or sublet without prior written approval. Any approved transfer must also agree to these Terms.


9. Sharing a Booth

You must receive prior written approval to share a booth. We may request full details about the additional vendor and may charge a shared space fee.


10. Conduct

Vendors must treat all staff, visitors, and fellow vendors with respect. Disruptive behavior, harassment, or intimidation will result in removal from the event without refund.


11. Booth Appearance

Your booth must remain clean, professional, and contained within your assigned footprint. Displays must not block or interfere with others.


12. Liability for Damage

You are responsible for:

  • Any damage caused to the venue by you or your staff
  • Compliance with safety laws and proper product function
  • Obtaining all necessary permits or licenses

13. Setup

Setup times and booth locations are assigned in advance. You may not move or adjust your location without prior approval. Requests for specific placements will be considered but are not guaranteed.


14. Safety

You must maintain a safe environment at your booth. This includes:

  • Avoiding trip hazards
  • Cleaning spills immediately
  • Keeping aisles clear
  • Ensuring stable and safe displays
  • Responding to emergencies per Vendor Manual instructions

15. Parking & Traffic

Load-in/out details will be provided in the Vendor Manual. Vendors must follow all local parking laws and respect surrounding businesses and neighbors.


16. Market Cancellation by Colorado Makers Market

The market is held indoors, rain or shine. We reserve the right to cancel in cases of:

  • Dangerous weather
  • Venue damage
  • Public health emergencies (e.g., pandemics)
    All fees are non-refundable, even in the event of cancellation.

17. Risk & Property

You are solely responsible for your belongings, merchandise, and booth setup. We are not responsible for theft, loss, or damage.


18. Limitation of Liability

We are not liable for any damages or injuries that occur due to your participation in the market. This includes physical, emotional, or financial harm.


19. Insurance

You are responsible for securing your own business/vendor insurance. We do not provide coverage.


20. Sales Tax

You are responsible for collecting and remitting your own sales tax per Colorado law.


21. Marketing Use

By participating in the market, you agree to allow us to use images of your products, brand, or booth for promotional purposes. You grant us a royalty-free license to use this content.


22. Indemnification

You agree to indemnify and hold harmless Colorado Makers Market from any claims or costs resulting from your actions, including IP disputes and liability claims.


23. Remedies for Breach

If you violate these Terms, we may cancel your space, remove you from the market, and deny future participation. No refunds will be issued in the case of breach.


24. Dispute Resolution

Vendor disputes (including IP concerns) must be handled outside of market hours. If disruptive, we reserve the right to remove the offending vendor. We will not mediate vendor disputes but may ask that products in question be removed temporarily.


25. General Terms

  • Headings are for clarity only
  • No employment or partnership is created by participation
  • No waiver is implied by delay in enforcement
  • If a clause is unenforceable, the rest of the Terms remain valid
  • These Terms, along with the Vendor Manual, form the entire agreement
  • Changes must be in writing and signed by both parties

26. Code of Ethics & Brand Integrity

Vendors must sell only items that reflect their own original work, craftsmanship, or brand identity.

  • No reselling of mass-produced, imported, or drop-shipped goods unless clearly disclosed and approved in advance.
  • All products must be represented honestly in your application and on-site.
  • Any violations may result in immediate removal from the market and future bans.

27. Noise, Scent & Sensory Guidelines

To maintain a positive customer experience, vendors must:

  • Avoid disruptive noise (e.g. loud music, speakers) unless approved
  • Refrain from diffusing strong scents without prior approval
  • Keep lighting within booth boundaries

28. Children & Pets

Vendors are responsible for their children and/or pets on-site.

  • Children must remain within booth boundaries and be supervised.
  • Only well-behaved, leashed pets are allowed, and only if permitted by the venue.

29. Electricity & Fire Safety

Vendors requesting electricity must:

  • Use grounded, commercial-grade extension cords
  • Avoid daisy-chaining multiple cords or overloading outlets
  • Comply with local fire code requirements
    Open flames, candles, or cooking appliances are strictly prohibited unless pre-approved.

30. Photography & Media

The Colorado Makers Market reserves the right to photograph the event, including vendor booths and products, for archival, promotional, and social media use.
Vendors may not obstruct or restrict photography by staff or official photographers during public hours.


31. Zero Tolerance for Harassment

We maintain a zero-tolerance policy for harassment of any kind, including based on race, gender, sexuality, disability, or religion.
Any reports of inappropriate behavior will be investigated and may result in removal without refund.
